A tragic event occurred in July 2019 at the Government Medical College and Hospital (GMCH) in Nagpur. Pushpa, a 59-year-old widow of retired superintendent Kewalram Patole, died unexpectedly after undergoing cosmetic thyroid surgery. Allegations of carelessness and wrongdoing by the medical staff, including the dean of GMCH Nagpur, Dr. Raj Gajbhiye, and eleven other doctors participating in the surgery, prompted a legal and medical investigation following this incident.
Due to thyroid issues, Pushpa was admitted to GMCH Nagpur, where her medical journey started. On July 6, 2019, the medical team led by Dr. Raj Gajbhiye carried out the cosmetic thyroid surgery. But after the procedure, Pushpa’s condition quickly declined, which ultimately resulted in her death. At first, cardiac arrest was listed as the cause of death; however, further investigation turned up claims of medical malpractice.
Kewalram Patole, Pushpa’s husband, accused the medical staff of grave misconduct and neglect, stating that the real reason behind Pushpa’s death was hidden. Patole tried to file a complaint, but the police did not immediately lodge a formal report (FIR), so he decided to take legal action. He went to the court, that is, the court of an extra chief judicial magistrate, and asked that they look into the matter and make the doctors accountable.
Pushpa’s husband, Kewalram Patole, raised serious allegations of negligence and misconduct against the medical staff, claiming that the true cause of death was concealed. Despite his attempts to file a complaint, the police initially did not register an FIR, prompting Patole to seek legal recourse. He approached the court, specifically the court of an additional chief judicial magistrate, seeking intervention to investigate and book the doctors involved.
In accordance with the court’s orders, the Ajni police filed a negligence complaint against Dr. Raj Gajbhiye, the dean of GMCH Nagpur, and eleven other medical professionals under section 304(a) of the Indian Penal Code. The initiation of this legal action signified the start of an extensive inquiry into the circumstances surrounding Pushpa’s surgery and eventual demise.
As the chief of the surgery department at the time of the procedure in question, Dr. Raj Gajbhiye insisted that Pushpa’s surgery was performed in accordance with conventional medical procedure. He defended the activities of the medical team, stressing that they carried out the treatment in accordance with accepted protocols.
Kewalram Patole’s fight for justice on behalf of his late wife emphasizes how crucial accountability is in the medical industry.
