Judge’s Frustration Over CBI Lawyer’s Delay Fuels Tension in RG Kar Rape-Murder Case Hearing

A horrific scene was shown to the Kolkata court on Friday during the RG Kar hospital rape-murder case hearing. The case centers on Sanjay Roy, the main suspect in the August 9 rape and murder of a junior doctor, age 31. The court spectacle resulted from a CBI lawyer’s delay, which greatly irritated the presiding magistrate, Additional Chief Judicial Magistrate Pamela Gupta, and made her question procedural rules.

The issue arose when CBI attorney Dipak Poria failed to show up on time, causing the hearing to be postponed by fifty minutes. The magistrate became openly frustrated with the delay and questioned if she should give Roy bail only because the public prosecutor wasn’t there. “If the lawyer is not present, he (Roy) should be granted bail,” Gupta commented. The magistrate’s patience ran thin as the delay persisted, and at 4:20 PM, she instructed the CBI official to get in touch with Poria. After fifteen minutes, the officer went outside, made a call, and came back to say the lawyer was on his way.

At 5 PM, when Poria did show there, defense attorney Kavita Sarkar took the chance to attack the CBI’s handling of the case. Sarkar contended that since Roy had no criminal history and no evidence had been shown against him, he should be given bail and questioned why the CBI’s representation differed from earlier hearings. The prosecution’s apparent hesitation and tardiness in presenting a convincing case against them was also criticized by the defense.

The CBI’s “full-time lawyer,” Poria, revealed that the organization was against Roy’s bail request. Despite this, Judge Gupta chose to remand Roy in judicial custody till September 20 in light of the CBI’s request and the ongoing investigation.

The CBI, which assumed control of the case from the local police, has not yet reached a conclusion despite conducting a thorough investigation and administering polygraph tests. The organization has had to cope with difficulties such handling the intricacies of a delicate case involving a deceased victim and depending on evidence gathered prior to its involvement. The investigation, which is still ongoing, has also looked into the involvement of Sandip Ghosh, the former RG Kar Medical College and Hospital principal, and other people who might have been related to the crime.

The next court proceedings are set to further examine the claims and evidence in this case, which is still under investigation by the CBI.
